ICNA Canada’s online syllabus: pregnant adulteress to be stoned after giving birth

The book “Riyad us Saliheen” (“The Gardens of the Righteous”) which appears on ICNA Canada site adds modern commentary to the verses from the Qur’an and hadith.

The following are excerpts from the book which deal with the stoning of a pregnant adulteress:

[Hadith]: 22. Imran bin Al-Husain Al-Hhuza`i (May Allah be pleased with him) reported: A woman from the tribe Juhainah came to Messenger of Allah (PBUH) while she was pregnant from (Zina) adultery and said to him: “O Messenger of Allah! I have committed an offense liable to Hadd (prescribed punishment), so exact the execution of the sentence.” Messenger of Allah (PBUH) called her guardian and said to him, “Treat her kindly. Bring her to me after the delivery of the child.” That man complied with the orders. At last the Prophet (PBUH) commanded to carry out the sentence. Her clothes were secured around her and she was stoned to death. The Prophet (PBUH) led her funeral prayers. `Umar submitted: “O Messenger of Allah! She committed Zina and you have performed funeral prayer for her?” He replied, “Verily, she made repentance which would suffice for seventy of the people of Al- Madinah if it is divided among them. Can there be any higher degree of repentance than that she sacrificed her life voluntarily to win the Pleasure of Allah, the Exalted?”.

Commentary: This Hadith highlights the following five points:

l. It confirms the validity of the punishment of Rajm [stoning] for the adulterer, that is to say that he should be stoned to death.

2. The merit of sincere pardon.

3. The description of fear of Allah as well as of accountability on the Day of Resurrection by the Prophet’s Companions, and their preference for punishment of sins in this world rather than in the Hereafter.

4. It is permissible to perform the funeral prayer of one who has been guilty of major sins, provided he has not been taking them as lawful because in that case there is danger of disbelief..

5. A pregnant woman cannot be punished with Rajm until she gives birth to the child and the period specified for suckling the baby is completed.”

“INSTRUCTING THE PATIENT’S FAMILY TO BE KIND TO HIM – CONSOLING THE PATIENTS AND SHOWING KINDNESS TO ONE FACING DEATH SENTENCE

[Hadith]: 913. `Imran bin Husain (May Allah be pleased with them) reported: A woman belonging to the Juhainah tribe came to the Messenger of Allah (PBUH) after having conceived from Zina. She submitted: “O Messenger of Allah! I am liable to Hadd (punishment ordained by Allah), so execute it.” The Messenger of Allah (PBUH) called her guardian and said, “Treat her well and bring her to me after delivery.” He acted accordingly. Then the Messenger of Allah (PBUH) commanded to tie her clothes firmly around her and then stoned her to death. He (PBUH) then offered funeral prayer for her. [Muslim].

Commentary: This Hadith has relevance to the theme of the chapter as we see it. Moreover, it reveals that if a woman becomes pregnant after committing adultery, she will not be subjected to punishment immediately. Instead, the penalty [stoning] will take place after childbirth. This will certainly contribute to the remission of her sins and will also be a factor in offering the funeral prayer for her.

The act of stoning is also a “purification for the believer”

Sheikh Faisal Hamid Abdur-Razak (الشيخ فيصل حميد عبد الرزاق), a well known Imam in Brampton, Ontario, who also serves as President of the Islamic Forum of Canada and Vice-President of the Islamic Council of Imams of Canada, said in a sermon few years ago the following:

“Even in Islamic Sharia [Law] the act of stoning is also done to reject certain evil actions, evil deeds. If someone commits certain crimes in Islam, and he is found guilty by an Islamic court, one of the punishments is stoning to death, signifying our rejection of evil actions as well.”

“But there is something else; there is something else that the stoning does to the believer. For Iblis [satan], for the Shaytan [satan], is rejecting him [refers to one of the rituals during the annual Islamic Hajj pilgrimage to the holy city of Mecca, in which Muslim pilgrims fling pebbles at three walls signifying the stoning of the devil] and rejecting his attempt to influence us.”

“But for the believer there is an important benefit. Someone in the time of the Prophet, peace be upon him, committed an immoral act, which requires stoning, came to the Prophet, peace be upon him, and confessed the Prophet, peace be upon him, and the Prophet kept turning away from him, Glorious is Allah, as he didn’t want to hear it.”

“But the companion [صحابي] he knew he had done something wrong, he kept going in front of the Prophet, peace be upon him, [and said]: ‘O Messenger of Allah [يا رسول الله] I did this, I must be punished. The Prophet, peace be upon him, kept turning away, moving away from him, as he didn’t want to hear this and the companion [صحابي] ] kept persisting, going and walking in front of the Prophet [saying]: ‘O Messenger of Allah [يا رسول الله] I did this, I must be punished.”

“And finally the Prophet ordered that he will be stoned to death. And this was done, and the Prophet, peace be upon him, ordered that he will be prepared for [an Islamic] funeral [جنازة] and the Prophet himself prayed [in] his funeral [جنازة]. He [Mohammad] told his companions: ‘he is in heaven [جنة], he is purified, he is purified’. So, this act of stoning now [meaning as is learnt from this story] is also purification for the believer.”

Showing kindness to one facing death sentence”

The following is a excerpt of Sheikh Faisal Hamid Abdur-Razak’s book: The Book of Death:

“CHAPTER 5 CONSOLING THE PATIENTS AND SHOWING KINDNESS TO ONE FACING DEATH SENTENCE

“5.1 Imran bin Husain (May Allah be pleased with him) reported: A woman belonging to the Juhaina tribe came to Allah’s Messenger peace be upon him (PBUH) and she had become pregnant as a result of fornication. She submitted: O Messenger of Allah! PBUH, I have done something for which punishment must be imposed upon me, so impose that. Allah’s Messenger PBUH called her guardian and said: Treat her well and bring her to me after delivery. He acted accordingly. Then Allah’s Messenger PBUH commanded to tie her clothes firmly around her and then stone her to death. He then offered her funeral prayer. (MUSLIM)”
